Long-Term Residence

This is a Long-Term Residence Permit that allows holders to both live and work in Spain on an indefinite basis, under the same conditions as Spaniards.

Criteria:

  1. Persons who are neither citizens of a country in the European Union (EU) or party to the European Economic Area (EEA) Agreement or Switzerland, and are not family members of a citizen of any of those countries wherein the regime of EU citizenship is applicable.
  2. Persons whose status as resident in Spanish territory is legal.
  3. Persons who do not have a criminal record either in Spain or in the countries in which they have previously been resident for any crimes recognised by the Spanish legal system.
  4. Persons who have not been prohibited from entering Spain and have not been listed as unwelcome within the territories of countries with which Spain is signatory to an agreement in this sense.
  5. Persons who, should such be the case, are presently not under any obligation not to return to Spain, assumed thereby following a voluntary return to their country of origin.
  6. Persons who find themselves in one of the following situations:
  7. a) Having been legally and uninterruptedly residentin Spain for five years.

In this sense the requiredresidence periodwill not be considered as having been interruptedas a result of continued absences from Spanish territory of up to six months, provided the sum of those absences has not been in excess of ten months,within the aforementioned five-year period. Should it be the case that these absences have been for work-related reasons, thensuch may not be in excess of one year, within the required five-year residence period.

  1. b) Having beenresident on an uninterrupted basis in the European Union for five years, as the holder of an EU Blue Card, always insofar as the said residence has been in Spainfor the two years immediately preceding the application date.

In this sense the required residence period will not be considered as having been interrupted by continued absences from Spanish territory of up to twelve months, provided the sum of those absences has not been in excess of eighteen months,within the required five-year residence period.

  1. c) Being resident and in receipt of a contributory retirement pension, included within the protective action of the Spanish Social Security system.
  2. d) Being resident and in receipt of a contributory full permanent disability or sever disability pension, included within the protective action of the Spanish Social Security system; or being in receipt of benefits that are equivalent thereto, obtained in Spain, consisting of a non-capitalizable annuity and, sufficient for their upkeep.

e)Being a resident, born in Spain and, after reaching the age of majority, having resided in Spain legally and uninterruptedly for at least the three consecutive year immediately preceding the application.

  1. f) Having been Spanish ab originem and having subsequently lost their Spanish nationality.
  2. g) Being a resident who, on reaching the age of majority, has been under the guardianship of a Spanish public entity during the five consecutive years immediately preceding the application.
  3. h) Stateless persons, refugees or recipients of some form of subsidiary protection, finding themselves in Spanish territory and having had their respective status recognised in Spain.
  4. i) Having made a notable contribution to the economic, scientific or cultural progress of Spain, or to Spain’s projection abroad.

In the above cases, the concession of aLong-Term Residence Permit will correspond to the Spanish Minister of Employment and Social Security, subject to the report issued by the Spanish Minster of the Interior.

Procedure:

- Legal standing for submission of the application: Foreigners, already resident in Spain, may either present their application in person or have it presented by their representative.

If not resident at the time of the submission then such must be in person.

In the case of persons that have made a contribution to Spain’s economic, scientific or cultural progress, the Spanish General Directorate of Immigration, subject to proposal by a public bodythat is competent in relation to the merit that has given rise to the application.

- Place of Submission:

Resident in Spain: At any public registry, addressed to the Office of Immigration for the province in which the person is resident. Information on the address, phone nos. and office hours can be consulted at:

Not resident in Spain and not in Spanish territory: at the Spanish diplomatic mission or consulate pertaining to the person’s residence.

- Long-Term Residence Permit Fees: Payment offeesis due on admission of the application for processing and will have to be paid within ten working days:

  • Holders of long-term residence permits will have to apply for renewal of their Foreigner identity Card every five years. Applicationsmust be presented during the sixty calendar days prior to the expiry date of their existing card. Should the application be presented at a later date, the corresponding penalty procedure may be initiated.
  • - The receipt for payment of the Card Fee of21.02 Euros.

  • If the electronic notification has been opted for, or in those cases where this means of notification is required by the regulations, then resolution will be notified by means of publication in the electronic office. Should the said resolution not be accessed within 10 working days,following publication, it will be assumed that notification has taken place).
  • - Time Limit for reaching a Decision on the Application: Three months, taken from the day following the date of entry to the registry of the competent body for processing. Should this term elapse without the receipt of notification from the Administrationthe application may be understood asaccepted, on the basis of positive administrative silence, except for those cases indicated in section i) having made a notable contribution to the economic, scientific or cultural progress of Spain, or to Spain’s projection abroad, in which case, should three months have elapsedsince the day following the date of entry to the registry of the competent body for processing and should the Administration hot have issued the expedient notification,then the application shall be understood as having been rejected.
